16th NNW International Film Festival
TERMS OF RECRUITMENT FOR COMPETITION SELECTIONS

§1. General provisions

1. These Terms describe the rules for submitting feature and documentary films as well as radio reports, later called “ for Competitions, as well as the rules of granting awards in these Competitions of the 16th NNW Film Festival (Niepokorni Niezłomni Wyklę ci), later called the “Festival”.
2. The 16th edition of the festival will take place between October 4-7, 2024.
3. The festival is international in nature.
4. The main organiser of the Festival is Stowarzyszenie Scena Kultury, located in Warsaw, address: ul. Bieżanowska 2/14, 02 655 Warszawa, e ntered into the register of entrepreneurs by the District Court for the capital city of Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000362534, NIP 5213580917, REGON 142525184, which is the legal holder of all the rights of the Festival.
5. The Festival is co organised by the city of Gdynia.
6. The goal of the Festival is to review and promote Works referring to the issues of contemporary history of Poland and the world.
7. The Festival presents Works showing various paths to freedom, both of entire nations and the individual freedom of each person.
8. The Festival presents Works through competitions and non competitive cycles.

§2. The sections of the Festival

1. Competition sections
a) International Feature Film Competition: feature productions, domestic and foreign, realised between 2022-2024
b) International Documentary Film Competition: documentaries, foreign and domestic, realised between 2022-2024 no longer than 90 minutes
c) Polish Documentary Competition: polish produced documentaries, realised between 2022-2024 no longer than 90 minutes
d) Radio Reportage Competition: radio documentaries in Polish, realised between 2022-2024 no longer than 30 minutes

2. Non competition sections
From the Projects submitted for selection, the organisers can choose the Projects for the non competition sections: special or non competition screenings.

§3. Deadline and terms of applying

1. The deadline for submitting films and radio reports for the Festival selection and the deadline for submitting
the required selection materials listed under subsection 2 is on May 31, 2024.

2. Rules for submitting films:

a) To submit a film (feature or documentary) for the Festival selection, you are required to:
• Fill out the online application form at www.festiwalnnw.pl
• Send the required selection materials to konkurs@festiwalnnw.pl a trailer of the film and three still images from the film (in .jpg format, at least 1920×1080 resolution)

b) Conditions for approving films for Festival selection
• You are required to provide an unlisted online link to the film on Vimeo, Youtube or any other online streaming platform no password protection required)
ATTENTION: Links requiring downloading files will NOT be accepted (i. WeTransfer, MyAirBridge).
Links also cannot be time or region restricted. Passwords for the links cannot be altered during the Festival selection.
• The review copies of films submitted for the international competitions (International Feature Film Competition and International Documentary Competition) are required to include English subtitles (does not apply to films with original English audio).
• One film can only be submitted for one Competition.
• If the aforementioned conditions are not met, th e film will not be admitted to the competition.

3. Rules for submitting radio reports

a) To submit a radio report for Festival selection, you are required to:
• Fill out the online application form at www.festiwalnnw.pl

b) Conditions for approving radio reports for Festival selection
• You are required to provide an unlisted online link to the radio report on Vimeo, Youtube or any other online streaming platform (no password protection required)
ATTENTION: Links requiring downloading files will NOT be accepted (i. WeTransfer, MyAirBridge).
Links also cannot be time or region restricted. Passwords for the links cannot be altered during the Festival selection.
• If the aforementioned conditions are not met, th e radio report will not be admitted to the competition.

§4. Selection

1. In the case of the Projects with extraordinary artistic value the Organisers can depart from the regulated requirements.
2. The Director of the Festival decides whether the submitted Project qualifies for the Festival.
3. The organisers do not allow a possibility of an appeal against the decision of the Director of the Festival.
4. Projects submitted to previous editions of the Festival will not be considered for the contest.
5. The selection commission holds the right to qualify a Project which applied for the Polish Documentary Competition for the International Documentary Film Competition.
6. The Projects not qualified for the Contests can (in a case of the Participants will) be presented during the non competition sections.
7. The results of the Festival selection is planned to be announced by the end of July, 2024. The results will be posted online at www.festiwalnnw.pl
8. The Organiser will inform the Applicant about the successful qualification of their Work for the Competition. The announcement will be sent to the e mail address provided by the Applicant in the online form at least 30 days before the start of the Festival.

§5. Language versions

1. The review and screening copies of films submitted for the international competitions (International Feature Film Competition and International Documentary Competition) are required to include English subtitles (does not apply to films w ith original English audio).
2. Upon receiving the information about qualifying for the participation in the Festival, the Applicant is required to provide a dialogue list in SRT format in both English and Polish (this concerns the films which qualified for the international competition).
3. In the case of the Contestant not delivering required by the Organiser documents the Project will not be admitted for the competition.

§6. Festival Screenings

1. Due to the non commercial character of the Festival, qualified Projects are shared to the Organisers free of charge. The Organisers do not pay for the licenses and renting copies.
2. Screenings of films, video clips and broadcasts of radio documentaries.
• Upon receiving information on the Project being qualified to take part in the Festival, the applying author is obliged not to withdraw the Project.
• Screenings of qualified films will take place in cinemas and outdoors as well as on line.
• All details of on line screenings will be discussed directly with the Project rights holders.

§7. Screening copies

1. The applying author is required to deliver two screening copies of qualified Project in two difrent formats: in the DCP format and MP4 Full HD (1080p).
2. If the applying author does not deliver a screening copies in a required formats, the Project will not be admitted for the competition.
3. The competition copies should be delivered by August 1 5 th 202 4 to the address:

§8. Awards

1. International Feature Film C ompetition
• Main Award is granted to the director and producer of the best feature film in the international competition

2. International Documentary Film Competition
• Witold Pilecki Award is granted to the director of the best documentary in the international competition

3. Polish Documentary Competition
• Golden Resistor Award is granted to the director of the best Polish documentary
• Janusz Krupski Award is granted to the director who showed special courage and went through  adversity in their search for themes and people who fit the main motto of the Festival: unruly, unbreakable, cursed.

4. Radio Reportage Competition
• The Main Award for the best radio documentary

5. Other awards
• Platinum Resistor for a lifetime of achievements
• The Spring Award for people passionate about history who with their work, knowledge and experience inspire film creators to take on historical subjects
• Award of the Director of the Festival for the artistic translation of the history to the language of film
• Audience Award for the best film chosen by the viewer s votes
• Blessed father Władysław Bukowiński Literary Award for intransigence in the search of the themes
• Other awards, approved by the organisers, funded by the Festival s partners and institutions

§9. Promotion

1. The Contestant agrees to have information about the submitted Project published on the Festival s website and social media, official prints, press materials and others.
2. The Organisers can, for promotional purposes, share the materials to the media, television stations and partnered websites.

§10. Copyrights

1. The copyrights of the project submitted to the Festival cannot be limited in any way, nor can they violate copyrights and personal goods of third parties; thus, when submitting a film, the author or producer of the film states that they are the legal owner or representative, who with the agreement of the owner of the copyrights confirms that they take upon themselves the responsibility for any eventual disagreements resulting from this, releasing the Festival s Organiser from and legal liability.
2. The organisers work in good faith and are not responsible for any cases of concealment of any information regarding the legal situation of the Project submitted to the Festival or participating in the Festival. In such case, all consequences and costs of legal work resulting from possible claims due to violation of rights of third parties are the responsibility of the applying author (the Contestant).
3. The organisers are not responsible for providing false information or information of third parties by the applying author (the Contestant). Providing false information results in taking away the right to receive an award.

§11. Delivery, return of film copies and insurance

1. Transport of the copies
• The costs of the transport of screening copies, as well as all other transport costs, are borne by the applying author
• The applying author is responsible for any custom duties abroad. The Festival does not cover custom duties outside Poland s territory.
• The applying author is obligated to comply with any custom duties regarding the transport of the films
• A pro forma invoice must be attached to foreign shipments from outside the European Union with a set value no higher than 15 Euro and with a note: “No commercial value. For cultural purposes only”.
2. Return
Screening copies will be returned at the expense of the Organiser in one month s time since the end of the Festival to the address provided by the applying author. The Festival must be immediately informed about a modification in the return address.

§ 12. Personal Data Protection

1. In accordance with art. 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (Journal of Laws UE L 119/1, as amended), hereinafter referred to as GDPR, we inform that the Administrator of personal data processed in connection with the organization of the Festival, including persons indicated in the film application form for the NNW Film Festival and data provided during account registration on the server. (portal) NNW Film Festival, is the Organizer, i.e. Stowarzyszenie Scena Kultury with headquarters located at: Bieżanowska 2/14, 02-655 Warszawa, Poland.
2. The Administrator has appointed a Data Protection Inspector, supervising the correctness of personal data processing, who can be contacted in any matter regarding the processing of your personal data by the Administrator by e-mail to: biuro@festiwalnnw.pl
3. The personal data of Festival Participants, including people submitting audiovisual works as part of Competitions and users of the NNW Film Festival website (portal), will be processed for the following purposes:
a) keeping records (submissions and selection of works), preparing and organizing the NNW Film Festival , in connection with submitting your work (feature film, documentary, TV pilot, videoclip, radio reportage) in the NNW Film Festival and acceptance the Selections Terms & Conditions of NNW Film Festival for the selection of the Festival – in relation to art. 6 clause 1 lit. b) GDPR. We will process your data provided in the application form for the period necessary to organize and conduct the Festival, including the selection of winners under the given categories of Competitions for the period necessary to organize and conduct the Festival, and in terms of achieving statutory objectives, i.e. documenting editions of the festival until the Administrator’s activity ends.
b) disseminating, informing and advertising the Festival in the media, documenting the Festival and publications about the Administrator’s activities in connection with the Administrator’s statutory activity, as well as for information and confirmation of the implementation of the sponsorship agreement concluded – in connection with the protection of the Administrator’s legitimate legal interest, in accordance with art. 6 clause 1 lit. f) GDPR. For this purpose, we will process your image, name and surname or artistic nickname until you submit a reasoned objection or request to limit the processing of your personal data. The Administrator informs that the Festival will be documented in the form of photos and videos on which images and voice recordings of Festival Participants may appear.
c) contacting you in matters related to the organization of the Festival and selection of projects, answering your questions, requests/complaints – in order to protect the Administrator’s legitimate interests, in connection with art. 6 clause 1 lit. f) GDPR – we will process your data in the form of name and surname, name and contact details or the content of your requests / requests until we answer you and settle the matter, no longer than 2 years from the end of the calendar year, in which we have done your business.
d) protection of the Administrator’s legitimate interests, i.e. for archiving and statistical purposes, as well as pursuing any claims arising in connection with the submission of works by the State to Competitions and taking part in the Festival. Your data will be stored until the possible claims cease to exist and for the implementation of the abovementioned purposes, transferring data to other entities authorized by law (implementation by the Administrator of obligations imposed by law) – in accordance with art. 6 clause 1 lit. c) GDPR, i.e. in particular on the basis of tax law, the Act on accounting, social security (e.g. for tax settlements, or related to accounting and reporting).
4. We obtained your data directly from you at the first contact (e.g. completing the application/registration form) or from a person authorized to submit a project work on behalf of the Competition for the organized Festival.
5. Categories of relevant personal data – we process your personal data to the extent necessary to implement the above. purposes for which we obtained data. These are such data as: name and surname and contact details (e.g. email address, telephone number).
6. Any person to whom we process personal data in the abovementioned for purposes has the right to request the Administrator to access the content of his personal data, receive a copy of it, the right to rectify it, delete or limit processing, the right to object to the processing. In addition, you have the right to withdraw your consent at any time, as long as the processing takes place on the basis of your consent without affecting the lawfulness of the processing that was carried out on the basis of consent before its withdrawal and the right to transfer data, as long as the processing of personal data takes place in an automated manner.
7. You have the right to lodge a complaint to the supervisory body – the President of the Office for the Protection of Personal Data, when the Administrator violates the provisions on the protection of personal data.
8. The recipients of your personal data, depending on the purpose of processing, may be: entities authorized by law to obtain personal data on the basis of legal provisions (e.g. ZUS, Tax Office, UODO), entities / persons cooperating with the Administrator as part of their statutory activities and commissioned cooperation agreements, i.e. co-organizers of the Festival, providers of technical and organizational services (e.g. as part of providing IT services), hosting, cloud (cloud computing), legal, auditing and consulting, accounting), as well as agencies, advertising companies, banks, companies providing courier and postal services, sponsors (sponsors) of the Festival in a given year – in the scope of sharing the image, recordings, names (first and last name, artistic nickname) and information about the awards received, participants of the Competitions – the full list of Sponsors is always available on the Administrator’s website: www.festiwalnnw.pl.
9. All persons and cooperating entities receive access to your personal data on the basis of appropriate authorizations and orders for the processing of personal data, including concluded contracts for entrusting or sharing personal data.
10. Providing personal data is voluntary, but necessary to participate in the Festival.
11. Your personal data will not be transferred to third countries, i.e. outside the European Economic Area (EEA).
12. Your data will not be subject to profiling (automated decision-making without human intervention).

§13. Final provisions

1. The organisers, represented by the Director of the Festival, decide on all matters not included in the hereby Terms.
2. The Organisers hold the right to change the Terms in any given moment. In a case of the change of the Terms by the Organisers the modified regulations come to life with the moment of publishing it on the website: www.festiwalnnw.pl
3. The Organisers hold the right to change the result of the contest publication term and providing a new term on the website: www.festiwalnnw.pl
4. The Festival can be cancelled at any point in time due to reasons beyond the Organiser s control.
5. In the face of the COVID-19 pandemic and the rules of the organisation of cuktural events in Poland the Organisers reserve the right to move the realisation of part or entirety of the Festival s program to the Internet with all the formal-legal consequences resulting from this, including the right to formulate and publish on-line materials and events provided in the Festival s program. Actions will be adjusted to the current epidemiologic situation and the recommendations of the Ministry of Health and the Chief Health Inspectorate.
6. Submitting a project for the Festival is synonymous with agreeing with the hereby Terms.
